The Terms and Conditions, Terms of Use, the Terms of Service and entire agreement between you and Fund The Planet with respect to the Website and the Services supersede all prior and contemporaneous understandings, agreements, representations and warranties, both written and oral, with respect to the Website and the Services.

1.1 Monthly Subscription
Your subscription will automatically renew on a monthly basis. Payment will be charged to your selected payment method at confirmation of purchase and at the beginning of each subscription period. The subscription continues until canceled in accordance with our Cancellation Policy.
1.2 Satisfaction Guarantee
We offer a 30-day money-back guarantee on all subscriptions. If you are dissatisfied with our Services, you may request a full refund within 30 days of your initial purchase by contacting our customer service.
1.4 Payment Security
All payments are processed securely through our third-party payment processors. We do not store your payment information on our servers.
1.5 Conservation Commitment
1.5.1 Protection Measures

1.5.3 Protection Guarantee

1.6. Explorer Platform Access
The Explorer platform provides real-time access to your protected forest area. Upon purchase, you will receive secure access credentials via email. Your access rights are personal, non-transferable, and valid for the duration of your subscription.
1.7. Cancellation Policy
1.7.1 Subscription Cancellation
You may cancel your subscription at any time through your account settings or by contacting customer service. Upon cancellation, you will retain access to the Services until the end of your current billing period. No refunds are provided for partial months.
1.7.2 Right of Withdrawal
In accordance with EU consumer protection laws, you have the right to withdraw from this agreement within 14 days without giving any reason.We extend this right to 30 days. To exercise the right of withdrawal, please contact us within the withdrawal period as detailed in our [Privacy Policy].
1.8. Intellectual Property
The Services, including all content, features, and functionality, are owned by Fund The Planet and are protected by international copyright, trademark, and other intellectual property laws.
1.8.1 License Grant
Upon purchase, you are granted a limited, non-exclusive, non-transferable license to access and use the Explorer platform and your Conservation Certificates for personal, non-commercial purposes.
1.9. Limitation of Liability
1.9.1 Service Warranty
We provide the Services on an “as is” and “as available” basis. While we strive to maintain high standards, we cannot guarantee uninterrupted access to the Explorer platform or satellite imagery.
1.9.2 Liability Cap
Our total liability for any claims under these Terms is limited to the amount you paid for the Services in the 12 months preceding the claim.
1.9.3 Exclusions
We are not liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Services.
1.10. Data Protection
1.10.1 GDPR Compliance

For business customers, we offer customized one-time payment options with individually negotiated protection periods and pricing. These arrangements require a separate written agreement.
As part of the Rainforest Protection Campaign Campaign, Fund the Planet provides certain Services, which can be redeemed and are accessible through Rainforest Tokens. Rainforest Tokens are minted in order to preserve rainforests and each of them belongs to a certain edition. Please, find the applicable edition below:
3.1 Genesis Edition
The following clauses apply to all and only the Rainforest Tokens of the Genesis Edition (the “Genesis RFTs”, singular the “Genesis RFT”). Genesis RFTs are identified as part of the Rainforest Protection Campaign and are part of the Genesis Edition of the Rainforest Protection Campaign. A Genesis RFT can be identified by its Token ID, which can be found in the image and in the metadata of every Genesis RFT, which is one of the consecutive IDs starting with the 001-001, followed by 001-002 and so on until 001-635.
Genesis RFTs were minted and distributed to preserve endangered rainforest in Peru.
3.1.1 Genesis RFT
A Genesis RFT is a voucher in the form of a non-fungible utility token. These tokens are smart contracts on the Polygon Blockchain, which is a second layer blockchain on the Ethereum Blockchain.
A Genesis RFT entitles its owner to obtain and use certain services from Fund the Planet, which can only be accessible through the Website. Therefore, please understand and agree to the Terms of Use before obtaining a Genesis RFT.
3.1.2 Validity
The Genesis RFTs are valid until 2122-01-01. At this date or any later date Fund the Planet has the right to disable any or all Genesis RFTs by any method, including, but not limited to, freezing or manipulating them. A Genesis RFT entitles its owner to redeem and use services from Fund the Planet if and only if it is valid.
3.1.3 Non-Refundable
The Genesis RFTs are non-refundable and cannot be exchanged for cash in part or full.

The Genesis RFTs are transferable.

2.1. Automated personal data processing – processing of personal data using means of computer technology;
2.2. Personal data blocking – temporary suspense of personal data processing (excluding situations when processing is required for any kind of clarification of personal data);

2.7. Operator – a state body or municipal authority, legal entity or natural person that is responsible, individually or
collectively with other persons, for organization and/or processing of personal data, definition of purposes of personal data processing, scope of personal data to be processed, as well as any actions (operations) related to personal data;

5. Legal grounds for Personal Data processing
5.1. Operator processes Users’ Personal Data only when the specific forms located on the website www.fundtheplanet.net are completed and/or sent to the Operator by Users. By completing the respective forms and sending the Personal Data to the Operator the User agrees to the terms and conditions of this Policy.
5.2. Operator processes anonymized data of Users only if it is allowed by the respective settings of a particular User’s web browser (storage of “cookies” and JavaScript settings are on).
6. The way Personal Data is collected, stored, transferred and processed
6.1. Security of Personal Data processed by the Operator is guaranteed by the implementation of necessary legal, organizational and technical measures that are defined by current legislation of the Germany in the field of personal data protection.
6.2. Operator guarantees protection of Personal Data and takes all necessary measures in order to prohibit access of any unauthorized persons to Personal Data.
6.3. Users’ Personal Data shall in no case be transferred to an unauthorized person, unless such transfer is required by the terms of current legislation.
6.4. In case of any discrepancies found in Personal Data, the User can make necessary clarifications by sending an e-mail to the Operator at privacy@fundtheplanet.net with a headline “Personal Data Update”.
6.5. The term of processing of Personal Data by the Operator is unlimited. The User can withdraw his/her consent to personal data processing at any time by sending an e-mail notice to the Operator at privacy@fundtheplanet.net with a headline “Personal Data Consent Withdrawal”.
7. Cross-border Personal Data Transfer
7.1. Before initiating the cross-border Personal Data transfer the Operator shall make sure that the foreign state receiving any such data provides reliable protection of the personal data subjects’ rights.
7.2. Cross-border Personal Data transfer to territories of the foreign states that do not provide adequate level of data protection can be conducted either with the written consent of the personal data subject for any such cross-border data transfer, or under the terms of an agreement for which the personal data subject is a party to.
8. Final Provisions
8.1. User can obtain all necessary information and clarifications related to processing of his/her Personal Data by way of a direct request to the Operator at: privacy@fundtheplanet.net.
8.2. This Policy shall be in effect for an unlimited period unless it is amended by the Operator and replaced by the new version in due course.
